WHO GETS EXCEPTIONS
Employer Practices:

Failing to hire or terminating an employee based on sex, religion, or national origin

Limiting opportunities or segregating employees based on those characteristics
Employment Agencies:

Refusing or failing to refer individuals for employment based on sex, religion, or national origin
Labor Unions:
-
Terminating members based on sex, religion, or national origin

Stereotyping or limiting opportunities based on these characteristics
These exceptions are limited and legally defined:

Businesses where sex, religion, or national origin is a bona fide occupational qualification (BFOQ)

Religious institutions and religious-based schools (for religion-based hiring)

Members of the Communist Party or related organizations
-
Cases involving national security
