UNLAWFUL PRACTICES

WHO GETS EXCEPTIONS

Employer Practices:

  • Failing to hire or terminating an employee based on sex, religion, or national origin

  • Limiting opportunities or segregating employees based on those characteristics

Employment Agencies:

  • Refusing or failing to refer individuals for employment based on sex, religion, or national origin

Labor Unions:

  • Terminating members based on sex, religion, or national origin

  • Stereotyping or limiting opportunities based on these characteristics

These exceptions are limited and legally defined:

  • Businesses where sex, religion, or national origin is a bona fide occupational qualification (BFOQ)

  • Religious institutions and religious-based schools (for religion-based hiring)

  • Members of the Communist Party or related organizations

  • Cases involving national security

WHEN DO YOU HAVE A CASE?

You may have a valid case if any of the following apply: >An employer cannot prove the action was job-related and essential >You were fired, stereotyped, or segregated due to sex, religion, or national origin >You were denied a job or referral for discriminatory reasons >You were rejected due to controlled substance use with discriminatory intent
