MUST-HAVE EMPLOYER PROVISIONS
Employers are required to provide:

🕒 Reasonable break time each time the employee needs to express milk

🛋️ A covered, private space (not a bathroom) designated for lactation
WHO GETS EXCEPTIONS
Employers with fewer than 50 employees are not required to comply if:
Providing a lactation space would cause an undue hardship, meaning:
The cost or difficulty would result in significant business disruption or expense
BREAK TIME COMPENSATION
COVERED EMPLOYEES
Employers are not required to compensate break time unless:

Required by state, federal, or municipal law

The employee is not fully relieved of work duties — in which case, the time must be paid as hours worked
The Act protects any employee who is:

Expressing milk for a nursing child

Has recently given birth, including:
-
A stillbirth
-
A child who is no longer in the employee’s custody

LIMITED EXCEPTIONS:
Air carriers may be exempt from some requirements:

When employees cannot be fully relieved of duties during flight time

During critical stages of flight operations
